Abstract
Employers across Canada are facing increasing scrutiny, investigation and prosecution for workplace safety incidents and fatalities. Increased enforcement by OHS regulators has proved largely ineffective. For example, fines of $1,500,000 and $2,000.000 for directors & officers and corporate employers respectively have not materially reduce incidents, injuries, and fatalities in Ontario. Therefore, this session will draw upon the presenter’s OHS lawyer of the year recognition in 2023 and 2024 to provide his 10 essential steps for employers to ensure legal compliance, reduce incidents, injuries & fatalities and ensure the availability of the due diligence defence in the event of enforcement actions by OHS regulators anywhere in Canada.
